I am a recident here in CA what happens if i get married to someone who is not legal here he been here since he was a baby his parents brought him here we have a baby together does any one know how hard it would be

If you marry him then you will have the right to file a K-3 visa petition to give him the right to be in the country legally.

If your baby was born here then he/she is already a US citizen. If the baby was born in a foreign country, but you are a US citizen, then you can apply for citizenship for the baby.

If your fiance has no legal problems "other" than being here illegally, then the visa should be a simple process. If he's been convicted of any crimes, then he could still face deportation, so speak to an immigration lawyer.

Once he has the K-3, and you're married, he can apply for citizenship after 3 years.

The best way is to get an immigration lawyer, I went through the same situtation about 4 years ago and just last year my husband finally got legal. Just cause an illegal marries a U.S. Citizen does NOT make them legal. You have to start doing paper work right away. You have to first fill out the for I-130 and when that application is accepted you can move on to get his work permit and Permanent Residence. But trust me start NOW. The sooner the better. It takes time and patenice and the fact that you have a baby together does help. Just a peice of advice, if you don't already put everything in both of y'alls name, because the first application is too prove that y'all are married for the right reasons and not for just papers. So all the billls and accounts make sure have both names.. Oh and take lots of pics, of you and his family and vice versa. Hope this helps.

I would advice that you seek the legal advice of an immigration attorny. Catholic Charities in your state have a legal department who handles this type of case for little or no fee depending on your income.

lMarrying an illegal alien doesn't legalize him. The baby and he are both illegal and need to go back from where they came! or go to jail. He is, after-all a criminal!

Uhm, marrying an American citizen automaticall makes you one. If the person has a child, the child is (I believe) still illegal.
