If you have the gate down, you need to put a flag (red rag etc.) on the end of the tailgate to warn other drivers.

As I recall the aero dynamics of a truck with the tailgate down gets better gas mileage.
Of course if you had loose items in the back that could fall out..... perhaps the Police officers was trying to avoid some type of accident.

Keeping it up seems to be a sensible safe and considerate way of driving unless you have a clearly marked overhanging load. I do not know about legality but I'm sure he could pick you up on something else if he tried to

You can always ask the cop to show you the actual state regulation they are referring to. Most of them carry the entire state vehicle code in their car, at least in CA. Most are glad to assist.
If you find one that is not otherwise busy, you can ask him politely to help you find the code the other officer was referring to.

yes because if you were rearended by a small car the tailgate could potentially become a guilotene blade, turning what would have been a simple crash into a vehicular homocide.
