Was he eating out of the can, or did you feed it to him? You can try to sue, but you might have a hard time justifying the fact that you cooked the vegetables and put them in a dish without noticing. Are you sure the plastic was in the can, and didn't fall into the pot while you were preparing the dish?

You can sue anyone for anything. If you have a case and could win is another story. And if it was canned vegetables I don't know that Kroger would be responsible. Probably more whoever made it.

That being said why do you want to sue? Was he hurt at all? do you have medical bills to recover? Or are you just looking to take advantage of someones mistake?

If he was hurt, then I am truly sorry and you should look to recover your expenses. If not, be thankful he wasn't and move on with your life.

Most likely you'll have to sue the canned vegetable company. Kroger would have no way of knowing it was in there.

You can sue - anyone can sue anyone else for anything - but unless he was injured you have no damages and therefore nothing to sue FOR.

Courts do not award judgments for what 'almost' happened.

If you complain to Krogers they'll probably give you some coupons.
