I'd speak with them and ask that they STOP their dog from doing this. If this failed I'd then call the Animal control officer and ask that they address it before I addressed it again.
And just for your info, NO I would NOT hurt the dog. I love dogs. BUT I would address it again and I would NOT be very nice the second time around. MORE so where I don't like the neighbor who lives on the other side of the fence.

BBQ-ed dog is very good
Advantages:
Free meat
No more holes under fence
Helping control the over population of pets
Disadvantages:
Neighbor might want some of the BBQ just tell him/her it is "mystery meat" a long long family secrete

approach the neighbor with the problem,if that doesnt help take the neighbor to small claims court for the cost of the damage.

Get a mixture of ground beef, tabasco sauce and metamucil and feed it to the dogs. It will burn going in and going out!
