Not realy, that person is selling car because he warranty is expired and he knows it will cost him a lot to fix it. My advice just add 10k and by new 3 seriose.

Private party in Excellent condition is $24K
Suggested Retail is $26,800 from a dealer with some sort of warranty.
You might try and lower the price a bit, a little bargaining might do it. Honestly its about 1-2 grand too much. I just looked up a 2004 X3 2.5i with the Premium pack and 35K miles for $22,500.

Its a little overpriced. But I would recommend against buying that car anyways.
Its underpowered, and eats a lot of gas...the X3s aren't even manufactured by BMW, they are outsourced to a Sweedish company. I would try for a different car, but if you really want one, tell him to lower his price by about $2-3k.

I am not sure your getting that great of a deal. Small SUV's with small motors. BMW used cars sell for less in markets like Texas.

the blue book will tell you if its a good value.... for me personally i think it is a little expensive. i rather buy a brand new japanese car and add a couple more thousand to the amount i will pay for this BMW.
