my friend wrote a beware to all the girls in our city to watch out for a guy no names mentioned and how he is a jerk and has a little thingy blah blah...he threatened to sue her for slander, deformation of character and all that. I told her there are no names, he's not running for president and no lawyer would take a case from a broke mother chucker to sue another broke person for something on myspace... am i right???

Unfortunately thanks to the wonderful legal system created by our wonderful lawyers, you can be sued for anything. It does not have to be valid and could just be a nuisance suit, but you can still file a suit. And you do not need a lawyer to do it. Any old person can walk in and file a suit in small claims court. At the very least, the person sued will have to waste some of their time and money to put in a motion to dismiss the case. If the SOB did manage to get a SOB lawyer to take the case, the person sued will have to hire another SOB lawyer to defend them.

The only people who always seem to come out ahead on lawsuits is the SOB lawyers, which is why they fight tort reform to the hilt.

While you are right that the case will not go anywhere, the SOB can still sue and make her life difficult.

Unless the description of the person was vivid enough to make a connection with the person being "slandered", then there is really no case. A good lawyer would usually state that the description is to vague to even argue. The guy is probably just trying to scare your into changing her myspace.

You got that right bro. No way. Who's gonna pay--this or that broke mother? All these guys telling you 'oh, he may have a legal case,' don't get it.

Yep !!!! Did you hear of the web page where the women posted their bad dates along with photos. I forget the name . They are being sued !!!

In a case like this he would have to prove damage done .
This case I am talking about the guy was a high profile kinda guy. So I am sure it effected him slightly different.

In addition to the other things she said about him he is blowing hot air. Anybody can threaten to sue anybody else for just about anything these days but no judge is going to allow something this silly into a courtroom.

actually if other people know who she is referring to, he could have a case and could find a low down lawyer to take the case. She should remove the comments, as in reality it makes her look childish and immature. So I guess it makes her look bad as well. People really need to think before they post stupid comments.

Heck, in the USA you can sue for a dog peeing in your flowerbed. But, that not mean you will win. Well, I better retract that last statement. In the USA you probably would win. It all who have the money to sue.

i really doubt it would hold up in court, if it got that far, but then again with all the crazy law suites today, who knows!

i dont think so.. i never seen anyone get rich from that only a priminister of canada or some govenment members
