I went in for a routine suction D&C following the birth of my daughter (the doctor believed there were retained POC's). It was supposed to be a 30-minute outpatient procedure with complications including cramping and spotting. I was given the option not to have surgery and to let it pass on it's own (the clot was getting smaller with every ultrasound), but there was some risk of infection. So, I agreed to the procedure. During the procedure, "something" happened, they haven't really been able to tell me how, but my uterus was perforated, my right fallopian tube was torn off, and my bowels were "bruised". Major abdominal surgery was performed and I was transfered by ambulance to the hospital, where I stayed for 24 hours. Friends/family have suggested a malpractice lawsuit to cover the 6 weeks lost wages, the hospital/ambulance bills and damages including the loss of fertility and added risk for future deliveries, which due to the size of the perforation will have to be c-section.

WOW! I am so sorry that you ever had to go through that! That is horrible! I didn't even know that was possible. Nothing like that was even covered in the list of potential hazards when I had my D&C.

Were you not already in the hospital?

When I had mine I was asleep in the hospital, I was told it was a quicker recovery than an epi. I was also told that bleeding can be bad and it is best to be in the hospital where I can be taken care of.

Generally I oppose the "SUE THEM" mentality, but in this case I think it is justified. There is just to much there to take on alone!

Not only that, but who are you to deal with all that with a baby?

Seek a councillor, a lawyer and of course, a new doctor.♠

well although it was horible what happened, i am not sure if malpractice law suit would be right, because more than likely you signed your life away when you agreed to get the dnc, such as your uterus perforated, and things in that sort. however you probably didnt sign something like loss of fertility. you could always call a lawyer and she if they think thye can help. but i would get a copy of everything you signed and see exactly wehat all the risks were. i am sorry this happened

Good grief! I hope you're feeling much better now!
Obviously something went wrong during the surgery and you need to get hold of your medical records and retain a good lawyer pronto.
Drs. have malpractice insurance to cover instances such as this.
Your lawyer will have this dr. checked out to see if there are other malpractice lawsuits against him.
Ask around to find a good malpractice lawyer.

You have every right to want to take legal action but first please consider a few things.

Did you ask how many of these procedures the doctor has preformed?
What was the rate of human error complications?

Do you have an ongoing relationship with the doctor? Do you still trust in his/her ability to care for your body now and during a future pregnancy?

Do you want to put your family and yourself through a long legal battle and have the expenses that go a long with it?

We do live in a litigious society but sometimes we just have to be grateful for what we have and walk away.

I think you should talk to a lawyer. I usually recommend to people not to go to lawyers that they have advertised, but to ask around for a referral. Take all of your information with you and go for a consultation. You can make your decision about legal action then.

Otherwise, I'm sorry for what happened for you. I hope you can find peace. You may call your local women's resource center and see if they have any support groups for people who have gone through things like you have. Best of luck.

That's horrible! I'm so sorry that that happened to you! I agree that you should consult a lawyer, that is major malpractice. Give yourself plenty of time to heal physically and emotionally, you have been through a terrible ordeal.

Sounds like you are a good candidate for malpractice.
At the very least, during the process you will find out exactly what went wrong.
