Me and my husband had a big argument, i was doing alot of yelling and i told him to get out or whatever, i guess the neighbors heard us and called the police or whatever, well when they came by they asked us what was going on and that someone had called them and said they heard yelling and rumbling we told them that we were just arguing and they asked if we needed counseling he was like well why not because we have trust issues, well they came questioning me and my daughter was like daddy pushed mommy because they kept asking him and did he push me and i said no it seem like they were trying to force me to write a statement, and i didnt write one or nothing but they still arrested him, to make a long story short, is it best if i try to find out when he goes to court and show up and tell the judge he didnt touch me or just not go, i just dont wanna make matters worse, plus they have a no contact order but we have a newborn baby together almost, what is the best thing to do?

and how could they ask my 4 yr old that or whatever because alot of times me and him play around the house and she thinks he is hurting me but he isnt thats why i try to explain to her to not to think or say that because of this incident that just happened

if i go to court, they will feel im in denial and i cant take my kids to court can i and we have a no contact order so being in court together is having contact

Answer no questions- they will only press the issue if they know something for certain, have proof or your admittance that something happened (guilty statement). If you have a court date set, you need to go other wise they can issue a bench warrant & come get you.

Asking a small child is out of bounds & inadmissable in court! As long as neither you or your husband say ANYTHING or give them any information, there is really not a lot they can do. They do try to force you to make statements because it is what they use against you & your husband. Even if you aren't arrested- remember you have the right to remain silent! Don't let them intimidate you. The job of the police is to protect & serve, but most of them are just bullies!

The court will believe your child because as the saying goes : from the mouth of babes. Your child has no reason to lie while you do even if it's not true. Of all the worst things to do is get into an argument with your husband with kids in the house and within hearing and visual distance. You both need therapy so does your kids if you both don't stop fighting like cats and dogs and just sit down and discuss your issues like mature adults.

They probably asked her because what you said and what the neighbors said where two different things. When the cops are called for domestic disputes they take someone away. (At least where I live) It gives everyone a chance to settle down and also so it will not escalate when they leave. You should not be doing this in front of your daughter. If she thinks he is hurting you when you play she should not witness this either. She is too young to understand yet and this is not good for her to be scared. I would go to court and tell the truth. Ignoring it will not make it better. It is best to deal with it now.

That is why parents shouldn't rough house. Children don't understand. No matter how you try to explain it, they don't understand. Now, looks like you both have a bit of a problem to fix.
Go to the court and tell the judge that counseling is desired. That way, the two of you have an oportunity to come out of this with the children's best interests at heart.
