Yes, he has the right to ask a US court to order a paternity test.

And he has visitation rights if he is the father.

But, he also has the obligation to pay child support if he is the father.

And, he could be prosecuted for statutory rape if your parents push that issue.

And, your parents have the right to keep their 15 year old knucklehead away from the deadbeat illegal alien child molester who got her pregnant.

I think you need to be careful of his motives. I'm not saying he isn't a good person, cause I don't know him. but he hasn;t expressed an interest in being in your sons life until now.

Here is why I say that. While the father is an illegal immigrant, he is now the father of an American, which will make him getting either citizenship or legal visas easier.

But if you are underage, and the father is not, he can go to jail for statuatory rape if he is the father cause he had sex with a minor.

They best option you have is talking to a lawyer. Most places have some sort of legal assistance (especially child advocates to help the fatherless) that will be very inexpensive or free to you. Find out your rights, his rights and what he gains by being his dad on paper.

However, let him be in the childs life. Make him pay child support, and let him be a dad. But make his visits supervised by you or someone you trust to make sure he doesn't try to take off with him.

No way should he be able to force the Issue, but since our court system seems totally screwed up in how it deals with Illegals who really knows. I would call ICE if I were you.The number is 1-866-347-2423. I would hope that if they can't tell you your rights on this issue, that they could at least direct you to someone that could.

YES, he can ask the court to force you to do a paternity test. How would you like it if someone kept your child away from you???!!! Fathers have rights to. They have rights to visitation and joint custody just like you do. It doesn't matter if you put father unknown on the birth certificate. Anyone can file a motion to prove their paternity.

He has the right to file in the courts in the USA or Mexico. Basically, where he technically lives or where you live.

He may want to prove the child is his so he has an anchor baby, that way he can stay in the US legally.
