I am in 8th grade and the school is doing this fundraiser for kids who can't afford to go on a field trip where kids sell Hershey with or without almonds, take 5, and Reeces peanut butter cups, kitkats, and carmelloes. however, there were so many people selling the boxes of candy alongside me, that the chances of somebody buying from me were one in a billion, making it hard to make any money.
I decided to buy butterfingers, mini recees, snickers, and kitkats from Casco because they are really popular and i make much more profit from selling Casco candy than school fundraiser candy, but people are telling me its illegal. I explained to them that i checked the candy for "no individual sail" text and there was none. Also, Casco candy was designed for people to sell because of the big boxes, from my understanding. My question is, is it illegal to sell candy you get at a store for a fundraiser? I am NOT lying when I say all the profits go directly into my hopefully possible fieldtrip.

If you were selling the candy and keeping the money, it would still be legal, you just may have some income to report. You can buy anything and sell it to whomever you want (unless you sign some sort of contract to not sell it). If you are donating all of the proceeds to charity, you may even have a tax deduction (if you are not reimbursing yourself for the candy). If you are only taking out the amount you paid for the candy, then you will be just fine.

Glad to see that an 8th grader can think outside of the box (the candy box in this case) and help a good cause.

Dude, sell the candy, you dont have to report an income or anything like that, the government isnt gonna look for an 8th grader whos selling candy bars and isnt paying the government thier $1.75 of tax you owe.
