I had a fire on September 18, 2007 - I am still living in a hotel. With this new microwave recall today, I decided to check on my microwave. ( Even though I thought my insurance company had done their homework) My microwave had a recall for FIRES in 2001. I of course was never notified. What recourse do I have with Kenmore/Sears ? My life was turned upside down after this fire......

I am soo sorry this happened to you.
I am or would be certain that you have a great case...thing is talk to your lawyer about punative damages...I think that anything that you would get in a settlement for actual damages would go back to the insurance company

you need to talk to an attorney because there may well be a class action lawsuit which occured and you could be or could have been a part of. It may be too late now to sue but an attorney can determine that for you possibly on a contingent fee bases - he doesn't charge you if you don't win and get money. Good Luck to you!!

You can seek legal advice, but however it would be hard to very difficult to sue such a big company.
