You need to talk to a family law attorney.
Unless he is a danger to you our your kids, then he has a legal right to be there if he doesn't want to leave.
If you were married in a community property state, then even if your name is not on the lease you may still be liable for the rent.
Your choices may be limited to moving out once the lease expired. Ask a lawyer.

First, go and see an attorney - legal aid if you can't afford one - and then file for divorce. since the kids hate him, the judge will more than likely give the house to you and he will be forced to sign papers taking his name off the lease. since he mentally abuses you on a daily basis you may be able to get a restraining order against him and he won't be allowed in he house no matter whose name it is in. Your attorney can help you with that. Good Luck to you!!

no longer being on the lease skill you do no longer technically have permission to stay there. That being pronounced, despite if he does have the main suitable to kick you out, he does no longer have the main suitable to maintain your stuff. in case you have receipts or warranties for any of the furnishings (and despite else you very own), be confident to maintain them on your handbag, only in case. If he could kick you out, only call the police and ask for somebody to come lower back out and supervise you as you get your stuff. The receipts and warranties that I noted would be very sensible if he could declare that he owned the furnishings. On an ingredient observe, once you're apprehensive approximately him kicking you out, why are you nevertheless there? i could the two recommend you get your call on the lease (once you're staying) or flow out and get your very own place, with your very own lease. no count how lots you adore the different individual, you frequently ought to look out on your very own hobbies as properly. continually have a lower back up plan in innovations in case issues elect out observe bitter. edit- who is going around giving each and every answer a bad score? Even the guy who quoted North Carolina regulation have been given a thumbs down. despite if one would possibly no longer only like the respond, you may no longer provide it a bad score for being maximum suitable.

And why did you marry him and make kids with him???? sorry, but women are stupid. (I'm a woman).
You need make a ultimatum - work full time always or you and the kids leave. That's it.
If he moves out, he'll leave mad and won't pay anything for the lease, probably, so be able to pay for a few months.
Filing for divorce will give you some money for child support, though if he's not into working, that won't give you any money.
when women divorce, they and their kids usually end up poor.
Men make more money and only pay a portion for child support and women don't get alimony since they work now.
Sounds like you're basically screwed.

If he intimidates you to the point that you believe he will physically harm you or states that he is going to physically harm you, you can obtain a restraining order. That will not allow him in the home or within 100 yards of you, where you live, and where you work and/or go to school.
Contact an attorney. There are many throughout the country that will provide a free initial consultation.

Go to tenant and landlord court/ housing court and file an order to have him removed. It may cost you a small fee depending on the state you live in every state is different, but don't lock him out until you have those papers b/c if you do and he calls the police you will get in trouble but with the proof it will show he doesn't belong there. Good luck

You have to file for a divorce and then you can go down to the landlord and tell him that you are seperating and ask that the lease be altered. And as far as kicking him out, tell him you want a divorce and you want him to leave. That should do the trick.

Sad to say by legal standards you cannot kick him out. You must be the one to move because your name is on the lease.

Yeah, I would talk to a divorce attorney. That would be the best course of action.
Then you'll have to talk to the Landlord after that.
