my son lived with his father in GA while i was locked up in AL. this was for several years. actually my son lived with his great g.parents. there wasn't a written agreement about custody. i've been out for over a year and now am able to care for my son. just found out on monday that in order for my son to live with me i have to get custody of him b/c his great g.parents have custody of him. how can they have custody if i never signed anything giving custody?

it might help if you have more details
because no telling what he did without hearing where you was when this happened..i dont want to make assumptions

If you are the biological mother and don't have custody another party can try to gain custody if they don't already have it and file for non-parental custody or adoption. But first they must prove that you are either an unfit parent or that you are a serious detriment to your son. It is your constitutional right to raise your son and that is protected under the fourth and fourteenth amendments...good luck.

Just a guess based on the lack of information provided - The father had sole custody would be on reason.

Well, if it's done with a Court order, yes. You should have received notice of the proceedings, but if no one knew where you were, they could accomplished by publishing the info.

Only if child protect services found you unfit or you was in jail and did not provide proper care for the child while in jail. Also if you just abandoned the child.
