I now receive the magazines (have received 5), but Penthouse has assured me i will not be charged. I have the online email confirmation where the person (I know who it was) falsely used my name, ordered the magazine and had it billed and sent to my home address. Penthouse will not give me the IP address, and before I began receiving the magazines the local PD said it was not enough just ordering it online to make a case.

Does actually receiving the magazines now elevate the matter? Is this anything such as mail fraud?

I did report it. Penthouse has stated it may take up to 12 months for the mags to stop coming. Also received various CD ROMS.

Yes, this is a pattern of harassment, and in fact we have TPO/CRO against the husband of the woman who sent these to us. She also went online and registered us with our names, address and phone numbers on a swingers sex site, psychologist site and others.

You have not attempt to defraud anyone, so they are leaving you alone.

It is cheaper for penthouse to just stop the magazines coming to your house than for them to pay investigators lots of cash over a $20-$40 subscription. They didn't give you the IP address because if you decided to retaliate (criminal actions) against somebody, Penthouse could be named as an accessory.

Every business deals with this. The end result is inflated prices... they can't completely control the fraud, but they can recoup the $$$ through the sales channels.

Unless you are being asked to pay for something you are not the victim of a crime here. As such, you really don't have any standing to pursue this. Penthouse may be a victim if they were not paid.

sound like harrassment to me. have they done other things.
if there is a pattern you can go to a lawyer and sue them for harrassment.
