I am not the biological mother, she is in prison I am his wife.

It means exactly what it says -- that he wants sole custody of his daughter, without sharing her with her mother. If the mother is in prison, depending on why she's being incarcerated, she may be awarded visitation rights while in prison, or even when she gets out. But your husband, if he's awarded custody, will have full parental rights and jurisdiction over the child, and his decisions regarding her welfare and upbringing will take precedence over all claims and/or requests of the mother.

I can see by the answers to your question, that people do not read the questions properly or in their entirety. However, sole legal and physical custody means, just that. He will be solely responsible for her. If and when the mother gets out of jail, she will have to take him to court to legally get visitation rights to her daughter. If she gets out of jail, your husband can also seek child support from her. Good luck.

physical custody means the residence, primary care giver.
legal custody means on paper who makes the religion, education, and medical decisions.

When my ex husband & I divorced, we agreed on joint physical & I have full legal.

Meaning, she does stay with him 1/2 the week, every week, and he has 1/2 the responsibility. BUT... if we ever cannot agree on anything, I have the final say so, on her behalf & well being.

If your husband wants FULL legal & physical, that means you will probably only get supervised visitations... to which he would have to have a lot against you for a court not to grant custody or visitation to a maternal parent. (the mother)

It means that he has the child and no one else has claims to her. Since the mother is in prison there will be no shared parenting or visitation and all of that. Physical custody means that she lives with him.

It means that the mother has no rights or say in the child's life.it also means that when the mother gets out of prison,he can ask the court for child support from her

Physical custody is that she would live with him full-time. With mom incarcerated, it's likely to happen anyway.

It would also be that he would basically be the one to make all important decisions regarding his daughter, without needing input from the mother.

She will live with him, he will make decision regarding her. The mother still have to pay child support but does not get a say so in anything. She does get visitation rights to see her.
