"The man told the dispatcher: "I'm getting my gun and going to stop them. The dispatcher said, 'No, stay inside the house; officers are on the way.','' said police spokesman Vance Mitchell. "Then you hear him rack the shotgun. The next sound the dispatcher heard was a boom. Then there was silence for a couple of seconds and then another boom.''

The telephone line then went dead, but the man called police again and told a dispatcher what he had done. He said he confronted the suspected burglars and asked them to stop, but they did not.

The man then fired twice, striking one of the suspected burglars in the chest, and the other on the side. The shooter's name was not released.

When police arrived, they found one dead man across the street, and the other two houses behind a bank of mailboxes in the Village Grove East subdivision.

The suspects' names were not released, but police said they had documentation from Puerto Rico, Colombia and the Dominican Republic.

No way. He may have had the right to defend himself if they had broken into HIS house. But if you see someone breaking into your neighbor's house you call the police, you don't take the law into your hands. There is a reason we have law enforcement and do not allow vigilantism.

After listening to the 911 call and reviewing Texas law; specifically the Castle Doctrine, it would appear that Mr. Horn was justified in his shooting. According to Mr. Horn the two men lunged at him when he approached them and asked them to drop their stolen loot. It would appear from the autopsy that both were shot from the front thereby corroborating Mr. Horn's story.

Texas justice is tough. If you want to steal things and burglarize homes Texas is the wrong state to do it. Pick another state like maybe California or a city that ban's law abiding citizens from owning firearms. You have to be smart to be a criminal today.

I believe in Texas they have a law on the books that allows you to shoot people on your property not your nieghbors but if these people are going to travel thousands of miles to be thiefs burglars or whatever terrible thing they had in mind then they deserve what they got also he did not go to thier homes or thier neighborhoods and whos to say when they were done with whatever terrible things they had planned for his neighbors that would not go to his or another house moral of the story if you do not want to be shot do not invade someones home get a job like everyone else

Yea. It's a weird deal. The tape I heard of the man said something like "your dead" right before he shot... He kinda sounded justified in his voice. Why didn't he shoot a leg or something? Not sure what to think of it but you can't go around with a shotgun shooting at people.

After listening to the 911 call I believe it was justified. Maybe something like this will make burglars and theives think twice before they steal someone else's hard earned belongings.

I can sympathize with the victim and the neighbor since I have been both a victim and a neighbor witness. I have been shot at and I have used my own weapon to stop a crime. Luckily, I did not have to shoot.

Unfortunately, I was taught that you can not use deadly force to stop a property crime. Unless the neighbor had positive proof that a life was in jeapordy, he was wrong for confronting the suspects.

ADDITIONAL COMMENTS:
After reviewing the transcript of the incident at the link provided above, I found the following statement.
"Under Texas law, people may use deadly force to protect their own property or to stop arson, burglary, robbery, theft or criminal mischief at night."
If that is true, then the shooting was justified.

if it was my house i wouldn't hesitate- i live with my parents and they are elderly,if it was a neighbour it would depend on the neighbour -one of mine is a right p****
