A friend of mine needs to get his record cleared in Massachusetts. Some felony. I was wondering how I would go about this. He got a lawyer... But his lawyer said to get his criminal record... I thought it's the lawyers job to do that? If not how can he obtain these records... and how can he go about doing this?

In Mass. you can file a "petition to seal" after a waiting period of 15 years after your conviction date for felonies and 10 years for misdeedmeanors. With the exception of law enforcement agencies and the department of children and families, no one will be able to see past criminal convictions if your petition is granted. Additionaly, you may deny that you have a conviction to employers. For certain drug offenses, it may be possible to bypass the waiting period. In order to get your record, google Massachustes Criminal Offender Record information, they have the procedure outlined on their website.

He can either get his record for free or pay his lawyer to get a paid copy. Sure makes a lot more sense to get the free one...

he needs to go to the clerk where the case was & pull the record. it's not an attorney's job to do this - unless he wants to pay their fee for something anyone can do for free.

ok--first off, you can not "clear" a felony off your record without a pardon. you can have your rights re-instated so that you can vote and stuff like that. you do have to have an attorney go to court to present your case to the judge. he will have to go to the city or county where he was charged and they will have to give him a copy.
