My work has a probation period of 3 months in the handbook, and I read that after a probation period you start accumulating holiday pay. Ive worked there for 9 months but the owner is saying that you have to work there for a year before youre entitled to start recieving holiday pay. My manager disagrees and also thinks its 3 months.

Ive read everything online but cant remember coming across anything that says how long you have to be working for an employer before you can take a holiday.

In the handbook it says your entitled to holiday pay - Thats it nothing about when you qualify or anything

You do have a RIGHT to holiday pay by law (I live in the UK)

There is a minimum right to paid holiday, but your employer may offer more than this. The main things you should know about holiday rights are:

from 1 October this year you are entitled to a minimum of 4.8 weeks

the entitlement will increase again to 5.6 weeks from 1 April 2009

those working part-time are entitled to the same level of holiday pro rata (so 4.8 then 5.6 times your usual working week)

It's up to your employer if they allow leave with pay.
There is no such thing as a "right" or "entitlement" to it.

edit - your entitled to 4.8 weeks holiday in the UK, it is up to your employer if they choose to pay you for that.

If you are talking a statutory holiday, you would only be entitled if you worked or were eligible for pay on the working days before and after the holiday. With only 3 months work, you may not even be eligible for holiday pay. The big question, is why are you giving notice after only 3 months? You will not have rights to any benefits including unemployment and how bad is the job that you would rather be unemployed and have nothing with which to pay your room and board.

You start accruing holiday entitlement from the minute you begin employment. A lot of companies will have a clause in the contract that you cannot take holiday within the first 3 months, but you still accrue it during that time.

The minimum holiday entitlement for every full time UK employee is 24 days (this can include bank holidays), so to say that you can't take holiday within the first year is unlawful.

As you just stated you read AFTER three months probabation period you BEGIN to ACCUMULATE Holiday and vacation pay. Accumulate means to start building not you are entitled to.. It is not the law that companies pay holiday pay or vacation pay it is simply something that the company has agreed to do as a benefit and it's their place to set up the rules and guide lines for this benefit.. be happy you have this benefit.. many people don't....

3 months I thought before you can take it,and it should be accumulated from your first day whether it's probationary or not.
Be careful,I've heard of some employers saying a year then when they get to that year they say you've lost it because you didn't take it before the new financial year so they basically rob you. It has to be taken before or close to the new financial year to get the taxes sorted unless they agree you can carry it over.If they agree to it,get it on paper,signed in blood.
Ring up the Citizens Advice Bureau to check your rites.

Every 3 months worked you are entitled to hol pay, eg, start 1st May it will be 1st Aug before you can have your 1 week hol pay, if you want 2 weeks off you will have to wait till 1st Nov to get paid hols, if you don`t take your hols before the next 1st May you will lose them, you can`t carry any forward. Hope this helps.
