If my wife was arrested for domestic battery and given 1 year probation for hitting me ( state has pictures )

In Divorce court, could this charge be to my advantage?

It will not give you an 'advantage' but will be taken into account. I presume one of you wants a divorce and the other doesn't - otherwise there is little point dragging up 'he did this, she did that' arguments. It is sufficient evidence to suggest that the relationship is not healthy and that the one seeking an end to it has good grounds for ending it.

Two years is a long time to let such a situation go on. Many states (USA) have no-fault divorce laws, so this wouldn't be much to your advantage in a straight divorce situation. For child custody it may help you a lot. However the judge may also wonder why you subjected the kids to her for so long.

You need a lawyer who specializes in divorce, preferably in marriages where there is documented spousal abuse. (I hope you do not use drugs or are an alcoholic.) If you have no kids the division may be 50-50. It is all like a Las Vegas Casino, you never know the outcome. You may end up paying alimony!! Or counseling costs for her!! Get a good lawyer, you may need one. She may be very aggressive in court against you. I would not like to be in your shoes.

ugggh yeah! Domestic battery is domestic battery... I don't know what took you so long to divorce her!!
