I'm not a criminal or a terrorist, so if the Feds wanna listen to me ordering a pizza or having phone sex with the girlfriend, more power to them.

Any challenges would be done under the 4th amendment's search and seizure rules if done by the federal government and in conjunction with the 14th amendment's right to privacy if done by a state governmental agency. A person has a right to be free from unreasonable searches and seizures and therefore, all government agencies have to obtain a search warrant (ie: this includes phone taps). There are exceptions, but generally, this is where you'd find your rights.
