If you and your wife have seperated for a month and there are no divorce papers and your wife has already moved in with new boyfriend. Is that considered cheating ?

In my opinion, not if you're separated, BUT I would wonder how long it was going on before the separation...seems awfully fast to meet and move in with someone within a month. Seems like they "knew" each other before....

yes, unless you have a legal seperation, or divorce, you are obviously still married and bound to each other. Are you asking this to put against her for a divorce? Cuz it could work, but may not since you are already agreed to be seperated, and she didn't cheat while you were still together. My fiance did the same thing as your wife is doing, and his wife tried to get him for it, but couldn't, but they were only married for a month, and they were 20 (stupid stupid kids lol)

As for me, I will consider that as cheating because you are just separated by word only and there are no legal papers that can prove that each party is already free to engage in another relationship. If i'm not mistaken, the wife is committing an adultery and not just cheating.

Yes! You need to have this documented. This will get you out of paying a lot when you go to court about the divorce. If you have children or she is wanting alimony, hire a private investigator to catch her on tape or do it yourself. This will save you from paying money you shouldn't be paying if she already has a boyfriend.

My ex fiance moved in with a girl within like a week. He met her only a couple days after we split. Doesn't matter what you call it...cheating or not....it hurts

It's considered moving on...Don't let life pass you by, it takes two to reconcile, and if neither of you are going to counseling or trying, then the best think you can do is see what your life can be with someone else...a new life.

Yes and in some states they still have adultery laws and you can file for divorce on the grounds of adultery

yes...I consider what my cousin is doing as cheating, her and her husband are legally separated bt she is still seeing/making plans to move in with her boyfriend from high school...from like 8 years ago.
That's crap I'm sorry...I don't think its even trying to work out.

ask the judge when you go to court...
meanwhile, move on.... apparently she doesn't have her head together, if she doesn't take the time to readjust to life or take the time to grieve her losses as soon as you have separated.
some people are totally stupid.
