I bought it at wal-mart without looking at the date, and it's a week old.

Yes it is legal, but if you took it back as soon as you realized that it was out of date, I am sure they would have allowed you to return it!

The question is, is it worth the cost of your gas and time to make a special trip to get back under $1, or would it make more sense to consider it a cheap lesson to look before you buy?

Yes, some people are Collectors. Of anything even old newspapers

If someone wants to buy it, then sure, no problem. Check the newspaper - there is no "sell by" date on it. :)
