If he collected the rent the month the note went default and he doesn't re-emburse you for the full months rent you can sue him. If he compensates you for the rent and possibly the hardship no you can't. If the bank forcloses on the proprety and they take your stuff and refuse to give it back you have to sue the bank, but you might also have grounds to sue him also.

Sure you can sue, since the landlord was not able to fulfill the terms of the lease, but do you really WANT to sue ? You will get a judgment, but it will probably end up not being collected. If the landlord had any money, the NOTE would have been paid.

If the landlord had money, he would have paid the note...........has no $$$$..............If you want to sue and can get a lawyer to take the case...........sue away.......

Depends if a lease was broken and if you were given sufficient time to move out. HELL SUE ANYWAYS!
