There are lopholes in everything. Getting paid cash for work is one. Doesn't help when you want to retire though and you don't have any money in any type retirement fund. Having your drivers license suspended is a loophole child support has. Even if you are not paying the support, it keeps adding up. The higher it gets, the more severe you will be treated at some time in the future. There are only five things that can garnish a SS or disability check. 4 are taxes and the fifth is Child Support.

If they are working any job "on the books" the employer is served with a garnishment and child support is taken out of the employee's check and sent straight to that state's child support agency (in NJ, the county probation dept). My ex, however, keeps changing jobs, so that by the time probation catches up with him, he's on to a new job and the search and paperwork starts again. "Under the table" means someone is working for cash, no taxes/social security/other payroll taxes/benefits are being deducted. The employee is not on the employer's payroll register and therefore, is virtually untraceable by child support agencies. It is also illegal for the employer to have employees working under the table btw. At one time, my ex worked under the table at a restaurant and his then ex girlfriend called me to tell me where he was. I called the wage and hour dept in the state and reported the employer and my ex. They stated I didn't have standing to report him since I don't work there, but when I pled my case about all the back child support he owed and he's using this to get away with it, the person I spoke to also turned out to be the victim of a deadbeat ex and the following week, wage and hour sent in their people, he was fired and the employer was fined.

ALWAYS DOCUMENT EVERYTHING and make every payment on time.
***I can not say this enough:***
DOCUMENT ~ DOCUMENT ~ DOCUMENT everything!!!!!
Pay consistantly, on time each month. DO NOT GIVE CASH.
Always pay by money order or check and keep copies of the receipts, money order stub, and cleared checks of EVERYTHING YOU HAVE PAID.
***If you pay directly to ex then get a file and keep organized records of every child support payment.***
***Keep receipts of everything you buy your children because EVERYTHING you buy can be applied to your child support arrears***if there is any. Never say it was a gift ~especially if there are arrears.
If there are arrears then the x can file to get income tax refund so don't file jointly with your new spouse unless the tax company you use documents it so the irs does not take your new spouses part of the refund. not sure about that but you will have to ask a cpa.
In some cases it it better to go through the child support enforcement office because it holds both sides accountable BUT if you ever get behind on a payment they will become the child support payee's enemy and no matter what your x is doing will not matter cause THEY WANT THE MONEY.
KEEP GOOD RECORDS on visits, children behaviors, phone calls, money, time spent and not spent together & etc.
The states look at child support and visitation as seperate so keep good records on both. You will thank me for this in years to come.

Look at this web site...print it off and glean from the information that can help you. It will show your rights. Don't be concerned with who it is for just the good information. I like it cause of it's lay out and simple to understand.
