from the landlord's permission, I find another roommate, we were to continue pay the old rent until end of November, and new lease plus new rent start 12/2007, then during the end of November the landlord gave us a 30 day notice to vacate dealine is 12/31/07(becaue we have rent deposit)saying we don't have a lease,eventhough our agreement was not in writing in the beginning, can we fight with landlord on that?

have you talked to the landlord? sure it wasn't just an automatic letter by his rental property department due to the fact its the end of your lease?

You need a lawyer. First strike - the contract was verbal. Does your state honor verbal contracts? Did you have a witness who heard the verbal contract especially the part that offered or allowed the renewal when the lease expired? Too many legal issues here. Unless you get a lawyer to issue an injunction against the landlord to give you time to present your case in civil court then better start packing and be out by the date the landlord says. Lesson learned -- grow up and don't ever make any verbal contract when it involves serious money. Rent is serious money. Go get a lawyer and good luck. Depending on which state you are at, you may have legal recourse. Maybe not. Your lawyer will let you know.

You can try and fight it, but if the facts are as you stated, then it won't do you much good, even with a lawyer. Sweetie P is wrong about not paying rent. You have to pay the rent even if the case goes to court, and the landlord needs to put it into an escrow account until the ruling. A person cannot live rent free even with an eviction notice. Also, a 30-day notice is legal in every state and if you don't comply, you could be removed forcibly by law enforcement personnel. Do the smart thing: pay the rent, go to court (if you choose) and present your case. If you are successful, all the money will be returned to you and, in some cases, with interest. Good luck.

probley not if your lease ends at the end of november they have every right to give you notice to move out when the lease is up. There is nothing u can do but look for a new place or ask them to sign another lease

Certainly. Tell him if he wants to be a jerk about it then you will see him in court. You could actually get away with not paying rent the whole time he has to wait to get you evicted which can take up to 6 months. Just keep getting the case continued.

remember verbal is very hard contract you said you give me a million dollors you would say were is your contract food for the future have it in writing and keep it all your documents
but if your lease said it was renegotable at end of term
then you do have the right to go to the renters tribunal and
make good of your contract

Check your local landlord/tenant rules. If you were in Ontario, Canada, your landlord would have the right if he had appropriate reasons.
