Which part is killing your fish? If they are getting sucked up the filter, take a piece of panty hose and tie it so it completely covers the intake, still generating water flow, but only trapping small particles, allowing the fish to swim as they please. If the waterfall is "crushing" them, take a piece of cork board and put it right below the output. You can put Java Moss on the cork and it will fill in, creating a lovely floating structure.

Theres really not a lot of options, either buy a new filter, try covering up your filter ( I really wouldn't recommend that though) or make more of a water fall like its meant to be. Since your filter's purpose is meant to suck water in and send it out in a higher place, then I would recommend making a waterfall, like build rocks upward (with liner underneith) and make a water entering the tank. That would be awesome! If you can't do that then get a new tank.
