BUT, she passed away in 1999! I am confused as to why I am receiving this NOW and what exactly it means. I know that when someone dies, creditors have a time period to claim against someone´s estate but why NOW? Would not that have been done in 1999?

A bit of history- her divorce was granted 2 days before she mysteriously died. Her husband (technically EX) kept everything and refused all contact with us, claiming harrassment, if we pursued any contact with him whatsoever. His attorney notified us of this via certified mail, so my siblings and I let it all go.

Now, out of the blue I get this letter from the same attorney.

Please advise as to what this is and why it is coming 8 years after her death.

I just found out that her husband died 2 years ago....

I would take a wild guess and say one word. Debt.
I suspect that your mother's creditors are after him, and he is saying it is not his fault that you and yours failed to go through probate. I am guessing he is going to try and blame you and that the creditors should seek you out for payment. There could even be taxes due. Right now, just wait and see. Check the probate court to find out if a Will has been filed. Good luck.

You could call the attorney that sent the notice. Ask him or her what this is. Probate laws vary from state to state. Therefore to get some unbiased advice, I would recommend you call a local attorney and get it from him or her.

It may be that some one has wised up that there were assets that should have been distributed. I think it would be best to not get advise from the internet. What you describe may be a very serious breach of probate code as well as possible criminal activity.

Apparently the will was just admited to probate and and executor appointed. CAll the administrator/executor and the probate court for specifics.
