What charges should I file?

1. Attempted murder of my "calamansi" tree.
2. Physical injury resulting in the loss of 3 or 4 calamansi fruits and several leaves torn from branches

Please help me make the legalese for the charges you think most appropriate.

No, the calamansi tree must file, he is the injured party. File a a frustrated murder of the calamansi tree. In your information, the tree already lost 3-4 fruits and several leaves, it is no longer in the attempted stage. The offender of the calamansi tree already performed all the acts which would produce the felony as a consequence but the felony was not produced due to reasons of causes independent of the will of the perpetrator.

You can only file the charges against the assailants of the calamansi tree if he died. But I think his leaves are still alive right?

You can no longer file physical injuries. The graver offense absorbs the lighter offense this time. Be sure to take aggravating circumstances against the criminals who done this murderous acts against the helpless calamansi tree.

The lawyer fees will be too much for what you can expect to get from such a case.
I suggest that you wait for the calamansi tree to heal itself first.
Once this has happened get both the Calamansi and the Atis trees to lurk in the shadows and wait for the perp. to come by again. When he/they come by let the trees unleash their fury and rage against the perps.
Revenge is sated.

Serioulsy, there really are jerks who are up to nothing.

So if you are bent on going after this jerk...and if you are residing in the Philippines, you can first report the jerk to the Barangay. The Barangay Captain will then summon both of you and try to settle the issue in their level.

Now, if you both do not reach an agreement, then it is time to call you lawyer.

But then again that is a waste of time and money... di ba?

So, do the same to his "calamansi tree" or whatever plants he has...hehehehe

You can take legal action under several statutes..... but likely the cost will exceed anything you might be able to recover......
FIRST, you need to identify your culprit. Once you do that, approach the individual or their guardian and try to resolve the matter in a peaceful calm manner. If that does not work.
SECOND If you live in a barangay seek the help of the Barangay captain. They often can mediate a settlement.
Always try to control your temper and be calm. Anger will get you anger, not solutions.
Do not threaten.
If none of the above provides a solution, then you can get a lawyer and take him to court for.....?? vandalism..... destruction of private property.....etc......but to do that you will need a police report. If you did not report the damage to the police and make an official blotter entry.....you will need to the next time it happens...... your word is not enough in a court.....you need proof of damage.

Actually you could file for destruction of private property, as well as destruction of future revenues (if you planned to sell the fruit), or destruction of a future agricultural venture. (if you can prove you intended to use the seeds from the calamansi fruit to grow more trees) Vandalism of said personal property. ( the calamansi tree and it's fruit.) You could also claim public nuisance, and disruption of your lifestyle. (IE, the loss of said fruit caused you to miss work / or be less productive due to psychological stress created by vandalism.)

(This reverence is considered by Abrahamic religions as unforgivable Pagan rituals ) While commercial exploitation for short term gain is just greed, many poor people are just forced to destroy resources simply for survival, or bullied by giant corporations All religions of the world have been violated by their own followers.

Yes. A plaintiff can file a lawsuit seeking damages of property and an injury being acquired by the "calamansi" due to firecrackers shall be replaced by the accused with a newly grafted or a few seedlings of "calamansi".

If the accused proven and tested under firecracker powder burn, a short term sentence will be charge against him/her and he/she will do a 1 year community service on Aref "calamansi" plantation..:)

Malicious mischief resulting in damage to property.

In a case like that, you will actually spend more than what the judge will order the defendant to pay. (attorney's fees, filing fees, etc)

emotional depression... I don't know if the term is right, but you can use that... try telling the jury that you became depressed due to the firecracker throwing to your 'calamansi tree'...
