without a rape kit being used almost right away, there probably is no physical evidence. Not sure why someone would wait 3 months to report a rape?

Maybe. Without the examination at the time, the physical evidence likely is completely gone. Your ability to establish the exact time of the event may be difficult after 3 months. You could get into a "he said, she said" situation similar to what occurred with Kobe Bryant of the LA Lakers several years ago. That does not mean you should not tell the police, it just means their job is going to be a lot harder and they may decide that it is impossible.

The sad part about this question is that the only real way other than someone seeing it or getting it on video, to tell they did it is to go in when the evidence is still there which is usually within around 24 hour. If there isnt any evidence then they cant make the arrest. But damn if I wouldnt kick his a**...

I'm not a legal expert, but I think it would be a very difficult case, unless there is some other kind of physical evidence linking the suspect to the crime.

Rape has no statute of limitations.
It may be a little harder to prove, but you still have the upper hand.
