Yes, it's illegal. Anytime you reproduce copyrighted material without written permission you break the law. Mailing it across state lines is incidental. However, you have about a snowballs chance in hell of going to jail for burning a couple cds....even if by some off chance the police confiscate your package and go through the contents to discover you have been naughty.
