My car was towed last night from a private lot. While I did end up paying I'm wondering if I could've demanded and got the car back forcing them to pursue other routes to collect from me (ie bill me, collection agency, small claims etc).

Most states give towing companies a lien on the car. That means that can keep it until you pay, just like a mechanic can.

Generally, in most States, yes they can.

It "might" be worth checking your States law on towing though - several States have laws that make tow companies - especially ones that tow from private property - follow specific procedures before they tow you, and if they didn't follow the rules 'exactly' then you're entitled to your money back, plus anything else that the tow cost you (taxi home etc,)

In many States, as an example, an employee of the property owner MUST be physically present to authorize a tow. (This is to stop tow companies making money by towing people from the parking lots of closed stores.)

They have the right to keep the car until payment in full is made. If they were required to tow it, that means that you parked the car somewhere you weren't supposed to be parked. They were contacted to remove the car, and that is that. They have the right to keep the car.

Yes they can keep it until you pay.,.....they also bill you for a storage fee on top of the tow bil

hahahaha of course they can keep it. They can use it as a bardering tool saying you cant have it until you pay
