According to the judge in my friends divorce, the man owns the ring.
The judge stated, the ring is given as part of a marriage contract. When the contract is broken, the ring is no longer the woman's property.

In my opinion, the guy owns it, because it is not just a gift. When someone accepts an engagement ring they are agreeing to marry the person. If they change their mind then they should return the ring. If however "the split" you are talking about is divorce, as in they did get married, then I say the wife should keep it.
That being said, I don't know what the law says about it.

Well, if you're splitting from the man, I really don't see why you would want to keep it, because all it would do is make you think of him, so generally the woman would give the ring back, or just sell it. Legally, I think the woman does, because the man gave it to her. If you want it, keep it. You could probably get a pretty penny for it on Ebay! ; )

legally - the woman, it was a gift.
However, if the woman broke off the engagement, she should, morally, return the ring. If the man broke it off - the woman has every right to keep the ring.

I think the woman should return the ring. The ring is a promise of marriage, of a life together. If the woman decides she doesn't want this, she should return the symbol of the promise of their life together. If the man breaks it off, why would the woman want to keep the symbol (except maybe to punish the man's wallet!)

It depends on what state you are in but in most states the man gets the ring back if he purchased it. Each state has their own laws regarding engagement rings.

The man does legally because it is a conditional gift, based upon the condition of the two of you getting married. Legally, he could take you to court (and win) should you refuse to return it. You could also have to pay his attorney fees plus any damage caused to his property.

If you are married, the woman keeps it.
If you are engaged still, it depends on who broke the engagement. If he did, the woman is entitled to keep it, if she did, she should give it back.
The exception is if it is a family heirloom. It should stay with the family it came from.
