My present husband adopted my children after we got married, I am now in the process of a divorce from him. The girls biological father wants rights to them and wants them to have his last name..Can an adoption be revoked or does he have to adopt them himself..how does this work..The girls want to change their name because the adopted dad isnt in the picture, and never calls them or comes to see them.

Hey Ang,
I don't believe you can just revoke an adoption. I think he would have to adopt them back or you could just do a name change for the girls which might be less hassle and cheaper. I don't know if he can get rights back after they have been taken away, I think that is the kind of thing that is permanent. Of course, you could just agree to let him see and visit with them. The adoption is just legal papers. You are their mother and can allow or not allow them to visit with whomever.
What you might want to do is just talk to an attorney that does free consults and see what options you have. That would be the best starting point really.

i never thought that someone can adopted someone elses children without the biological father giving up his rights to his children.... Unless the mother lied and said that she had no ideal who the father was or if the adopted father was the father.... But honestly if the real father wants a shot at fatherhood with his girls give him a chance to do so... But i fell changing the girls last name because you and your soon to be ex are getting a divorce and he is not there for them is not the answer to the problem weigh it out first....Let the girls get to know him and then see if they still want the name change....

If the girls want to change their name back that should be possible with only a little problem. As far as rights, unless he is abusive or should not be in the picture for some reason, it is healthy for the girls to know him and know that you both love them even if you do not love each other. since you are getting this second divorce I wonder if you waited long enough after the first divorce to get into another relationship and I will give you a site dealing with that before you get involved again with someone. That is a tough one but I would think that if they have been legally adopted by your present husband it will be irrelevant if you get divorced or not. He is still the father according to the law. Sounds like you will have to go to a lawyer and have this changed.

How did your current hubby adopt them without his consent? Usually the current can only adopt if the bio is deceased or he gives up his parental rights. You could have a fight on your hands, but good luck to you and the family.

Your husband has no criminal rights to make judgements to your baby. the baby's organic and organic father has the final to make judgements for his baby. in need of your husband adopting the baby,I see no way he could settle for permission to make scientific or criminal judgements for a baby that's not his.

it would b very hard to retain his role as father after adoption,but he still has certain rights,if the parent has left the children w/you,a lawyer could b more informable to your situation
