My lease expired months ago and I've finally found a new apartment. I've been paying my landlord on a month by month basis. For December I will only be in the apartment for half the month, is the landlord entitled to the whole month's rent?

On a month to month...most states would require you to pay the entire amount for the month. Since technically, your lease starts on the 1st of each month and ends on the 30th or 31st, then you would be responsible for an entire lease term.

When did you give the LL notice of your intent to move out? Did you give 30 days notice already? If you haven't given 30 days notice and you do now then the LL is entitled to the entire month. You can talk to the LL and see if they'll prorate your rent for the time you are in the apartment, but if you haven't sent 30 day's notice as required on a month to month tenancy then you arent' entitled to only pay 1/2 the month.

It depends on your state's landlord/tenant laws.

In most states you are required to give a 30 day notice which must include a full rental period. If this is the case, you are liable for the full months rent.

Yes, he is entitled to a full month's rent. The notion that rents are prorated are a common misconception. There are no prorations unless the landlord decides to allow one.

If you havent given notice you will lose your deposit and will probably owe the whole month if you have given proper notice then you may onl owe a partial month.Good Luck
