My sister lives in a house with No HEAT! When she went to turn it on this winter, she found that it didn't work, Her landlord told her to get some estimates on getting it fixed and that she would, then she told her that if she couldn't afford to get it fixed, that she would let them buy basebord heaters in lou of paying a couple months rent. Well Neither of them happend, It's now December and rangind from 20-30 degrees at night time, and still no heat, she has FLAT OUT told them that she will not help to put heat in the house in any way, How can a landlord rent a home without heat?????

In Ohio, you must provide thirty days written notice to the Landlord to remedy the problem. In the letter, she should add that if the problem is not resolved after thirty days, that the letter also serves as proper notice for terminating the lease in the future. If the Landlord ignores your sister, she must take a trip to the local courthouse. There, your sister will deposit the rent money with the clerk. She should then request that, one, the court lower the rent due to the Landlord's unlawful conduct. Two, either ask the court to terminate the lease or provide her with a portion of the deposited rent to fix the problem, herself.

By the way, it's spelled in LIEU not Lou.

In Ohio, the landlord has to "Make all repairs and do whatever is reasonably necessary to put and keep the premises in a fit and habitable condition" [5321.04]

Your options in Ohio seem to be as follows:

(1)Start escrowing the rent with the local municipal court.
(2) Petition the court to compel the landlord to make repairs.
(3) Terminate the rental agreement and move out.

#3 sounds like the most logical option. Leave the owner there with an empty rental and find some place warm!

Just remember to cover yourself by communicating with the owner IN WRITING. And please, seek legal aid to make sure you're covering all the bases!

Ummm....the landlord offered to let your sister purchase baseboard heaters in return for a couple of months of free rent. Why didn't your sister avail herself of this offer ? If your sister refuses, I'd venture that the landlord will purchase the baseboard heaters and install them, and then your sister will pay the full rents.

She was kind of dumb to NOT avail herself of that offer.
