my situation is that i moved out and didnt do a walk out inspection. i did clean the place but they say i didnt, so im being charged for that. plus theyre saying I owe money for back rent, but i gave a 30 day notice and moved out on the day i said. the only thing is, i put the keys in the drop box the next morning so i dont know it thats y theyre trying to charge me for rent or what. The first time i heard anything regarding the matter was over a year later from a collection agency. i just recently sent the collection agency a dispute letter and i guess ill go from there. is it just a lost cause if I cant prove anything or can i fight it and win. thank you

Cite the contract if the stipulations are in your favor regarding the charging of fees after an inspection.

I would definately try to fight this claim. I kind of went through a somewhat similar experience to yours a couple of months ago when my boyfriend and I moved out of our last apartment. The landlord there was a real piece of work. She always had a complaint about the way my boyfriend and I kept the apartment and she was very nosy. Everytime she came into our apartment, she was silently looking over the place to see if it was in good condition. My boyfriend and I finally started to wise up to her and we stood up for ourselves and let her know that we were basically organized people who kept the place clean. She would basically nitpick about any little thing that seemed out of place, and I mean the nitpicking would be about very trivial, nonsensical things that wouldn't have mattered to a reasonable person and that a reasonable person probably wouldn't have even noticed. And the funny thing was that when my boyfriend and I first moved into the apartment, we had to make a few minor changes so that we could live comfortably, because it seemed as if she and her husband hardly ever did any kind of maintenance work but then she had the nerve to compain if she saw a piece of paper on the floor. She basically acted like every issue concerning the apartment was our fault and that she had no responsibility in changing anything. And she had the nerve to try to make an increase in all of her tenants rent even though none of the apartments were worth the money that she was asking for. I made sure that on the day we moved out, I did a walk through with her and addressed all of the problems that had been in the apartment before we ever moved in so that she wouldn't be able to harass us or to try to keep any of our security deposit money from us. Because my boyfriend and I knew that we couldn't put it past her to try to do that. It's surprising that we actually got out of that apartment without completely going insane. And my boyfriend, who is a very calm guy actually got very pissed off with her by the end of the whole travesty.

Lesson learned, always take pictures the day you move in and after cleanup on the way out. Always give the keys to the landlord, or mail them registered mail, return receipt requested.

If the landlord is making a claim against you, it is up to the landlord to prove his claim. I think you are right to deny liability. The worst case is the landlord can sue you and win.
