Does your state have a law about owning a pit bull? Is the dog actually a pit bull? If it is not, you should be able to have a vet confirm it for the authorities. However, unfortunately if it is a pit bull and your state has laws against owning pit bulls then there isn't much you can do. I would talk to a lawyer. There are many that will give a free consultation and advise you. Good luck getting your pet back.

I wish they were illegal in my state. My neighbor has one and as far as I am concerned the fence have is not strong enough! That dog is doing alot of damage to her yard and the fence. I have to go over every few weeks to ask her to repair the fence or fill the holes the dog is digging under the fence. I saw her dog literally try to kill her other dog over a stupid biscuit. If you really love your dog...take it to the vet and prove that it has no pit bull blood in it. If it does...you have no choice but to get another dog.
