I was in a car that was backended at the time of the acciedent i did not seek medical attention because i felt alright. but later that day I was hurting so I went to the ER. My incurance paid for the hospital visit. But can I go after the other guy's insurance for my medication and pain and suffering. I suffered a cervical spin and shoulder sprain.

call an accident injury lawyer. most accident lawyers are no recovery no fee. that means if they don't get you money, you don't pay. they will talk to the insurance company, and get you a better settlement out of court, then you could get in court on your own. some times it does end up going to court.

Your insurance company is already going after them to get payment for what they paid out for you. If you have severe injuries (won't heal in 3-4 weeks) then yes, but if it's something that will heal in that time, no.

yes, just becareful not to ask for more than you deserve cause judges get pissed if you do that
