I was told on Friday by a co-worker that they have been asked to be in my performance review. When the Copy Director left the company right after I was hired, the decision was made to hire a senior copywriter instead. I was told when she started that even though I am a junior copywriter; she is in no way over me. We both report to the same person and have been working as equals for the past 6 months. Being one of my peers, it seems wrong for her to be in my performance review. Yes, I do look to her for guidance, but her being in my review will make the situation more awkward and even embarrassing. My husband suggests I speak to my supervisor before the review, but I would like proof that this is illegal before I proceed. Does anyone know of any laws against a co-worker being in a performance review?

I don't think there are any laws having to do with performance reviews; usually laws have to do with protecting the public welfare and safety. You would have to ask Human Resources if it's within company policy.

I dont know about legal But when I was supervising security personnel the only individuals involved in performance reviews were the rest of the supervisors and management no one else should be involved that is not over you. Unless your employerr has some twisted policy allowing non-management or supervisory personnel to decree who get promoted, commended etc..

Simply put your peer may be pulling your chain I can't see it anyother way but make sure and if the are telling the truth I would consider new employment before a peer tells you you are terminated and management agree just for the stupidity of it.

I hope this helps and that they lied to you.

It's unusual, but it isn't illegal. Did you ask your supervisor why the co-worker will be in your review since she isn't over you?

This is the prupose for having HR specialists. Their job is to know what is legal and what isn't.
Rest assured, that if this is what's being done at your company, it is legal.
