Can someone help me in telling - as to how much time it takes in India to get divorce in case un-contested divorce (one-party only). In total approximately how many times will the family court set dates for hearning the other party. How many months in total it takes generally for uncontested divorce cases. Thank you in advance for your answers

No particular time frame can be fixed for a divorce petition in India in the family courts. However if the unilateral divorce petition is being filled by one spouse the family courts orders for notice/summon to the other party on first date of hearing, in case this notice/summon is served & the other party fails to appear on the fixed date of hearing The family court may order for proceeding ex-parte or may again order for new notice/summon by post or dasti or by newspaper publication before proceeding for ex-patre in the case. In any case once an order for ex-parte proceeding is ordered the petitioner is asked to precede with the case by producing all the evidence he or she has for his or her petition for divorce. On recording the petitioner evidence & listening to his arguments the case is fixed for final order & passing of decree of divorce. How much time all, this will take depends how case is being handled by the counsel of the petitioner. An intelligent/competent counsel will get this whole matter expedited within two to three months & get the decree of divorce in the favor of the petitioner.

The honrable court pull the cases of divorece intensely. Court thought that after a time period the couple realize that we should live together. If they not do like this then the court collect the information of both's history, nature, behaviour and character etc. Then the court ask both to provide proof of alligations against each. Finally it depends upon the case. At last the Court take decision. In all of this time taken by court is apprx. 5 years normally. If your case is most senstive then court take 6 months only.

Nagpur: Can long separation of a couple be a ground for divorce? The Nagpur Family Court settled dispute by categorically ruling that it can't be. Citing Section 13 of Hindu Marriage Act, 1955, the court denied divorce to a 50-year-old man from Nagpur from his 44-year-old wife.
"It's the matter of record that the parties are staying separate since 13-14 years. However, only long separation of parties is not a ground to dissolve their marriage. Irretrievable breakdown of marriage is not a ground under Section 13 of Hindu Marriage Act to dissolve the marriage," judge Subhash Kafre held.

So there is no intelligent council all are useless work done so the judges only can give divorce that also the after 20 years if women want to delay the case then judges hands are tied in indian law so thats y indian men are drunk adicts and some even kill wife or mother in law and father in law, no fixed law in india for family cases. not only divorce all civil cases are will take many and many years before judgement that the petitioner life will end. So world listen india please do not bid with indian marrital law, if you moved already to other nations, just follow others law not indian hindu law very bad and cursing law for men.
