You strike the first punch you are guilty of assault or battery depending on the State. You may defend yourself but only equivalent to what force was applied to you, you cant run after someone in self defense. Some States like Texas with lax gun laws, you may use deadly force to protect your property, there are big problems with that as you might imagine.

What I think you are talking about is countries using preemptive strikes against other countries. In the US it is legal if there is an "imminent threat" against the USA. What the threat is and what is imminent is subject to interpretation and there lies some problems.

Sudan Judges are interpreting a law that is subject to interpretation, that interpretation changes depending on the political, religious and mob tendencies of the time.

I see where you are going with the analogy. I have thought the same thing. Can you kill your neighbor and simply say that you believed that he was trying to purchase a weapon so that he could kill you or might try to kill one of your friends? As JGF pointed out, there is nothing legal or moral about such an action.

I don't know about Canada, but things are changing fast here in the U.S.. We have reached the stage where the neocon's propaganda machine has their followers feeling that it is acceptable to use violence to eliminate opposition to their cause. That is beginning to include opposition from american citizens and not just foreign governments.

If the dude was a threat, yup... but you better be right... these made up straw men seldom happen in real life by real people unless the shooter is the criminal and shouldn't have the gun in the first place.

You are in Canada, here in the U.S. in most states it is legal strike a person that is about to hit you.
