I am modifying my child support. I went through the whole process for 2006. She is claiming that sheis only making about 16000 for 2007 but had claimed over 30,000 for the past two years. I gave her the business I built in the divorce and now she has ran it into the ground. She got remarried in August(Congrats to her) but can I go after his income since she is unwilling to get a job or try to better her business? Right now he is the main finacial provider for them.

You need to know the law of your State.

I don't think you could go after his income because the children are not his children .. and your & her divorce was not his divorce.

If he is the main provider for the household .. and the children live with her & him .. then he is already a participant in supporting the children by providing a home, food, etc .. for them.

In most States - the child support is determined by the person's Tax Return .. which then is referred to by a chart of payment. This chart could be given in Statutes. Child Support can be agreed on by the parties out of the court room - before it goes to the bench .. if it is ammicable by both parties - and agreed upon by the Judge.

I'm not 100 percent on this but I THINK you can if she isn't working and she has a another adult living with her and working I think you can do something about it I would try talking to your lawyer or someone like that. You may also be able to reduce your child support but lik eI said I'm not an expert on it so i really don't know so talk to someone with some legal advice hope this helps

She is remarried and there money is joint. It is worth the try to go after it. esspecially after ruinning a good business.
