I'm currently paying child support to my ex for my son. Can my ex and I make our own contract where I would buy a house and sign it over to her (and my son) instead of paying the set amount of child support each month?

Would the State allow that? It is in the best interest of the child and technically I am providing a roof over his head..

Depends on state law. It's very doubtful, as that money is supposed to be for the kid's food and shelter...not a long term property acquisition.

As a general rule, it is in your best interest to have an unbroken string of timely support payments to your ex...and a paper trail to validate it.

Now, if you two have a separate contract wherein she agrees to pay you a specified amount per month (golly, it could just happen to be the same amount as your child support) for X years...as rent for living in your house...maybe that will serve both your interests.

If your state allows lump sum child support payments, and if the courts confirm the agreement, then yes. But the value of the house will have to meet the obligation for the remaining number of years your ex would have been recieving support.
