my husband and i recently split b/c he refuses to get help for his anger issue and our infant son does not need to be around that situation. what is fair for child support? We are going to get a dissilusionment (how fitting to think that we where dissilusioned when married eh) and we need to come up with terms to agree on.

Usually the judge sets the amount for child support. If you are wanting to split the cost of caring for your son then you should take into account EVERYTHING that you would normally buy for your son in a month period and divide it evenly between you. If I were you I would set up visitation and such along with setting the child support because when you let it be an as agreed upon deal then someone always ends up on the raw end. Good Luck!! It's not disillusionment, it's dissolution (to dissolve). Child support is not usually calculated based on what seems fair, there is a law in each state on how it is to be calculated. Your attorney should be the one to calculate it (his attorney will calculate it and may come up with a different number, then they figure out why or agree to meet in the middle - mine and my ex's came out different because the attorney's used different income tax rates for me).

Some states use a % of the non-custodial parents income, some use both parents incomes.

You need to speak to a solicitor, about how much your husband pays ,if you are working apply for working tax credit and child tax credit I'm sure you will be entitled to it and if you are they back date it for up to three months you can get info on line or ring them up they are really help full,for sure sort your finances out first and foremost good luck

Child support agencies will take a percentage of his wages depending on how much he makes and in my case it varied depending on what kind of custody there was.....joint...primary...etc.
