How do you file for rights to a company or business name? I thought that filing for a "fictitious name" was the answer but it clearly states that this does not create any "exclusive or any other right in the ficticious name."

If you are in the U.S. contact the Sec. of State Business Division. They can do a search on your co. name. If it's already taken than you can't use it. I would advise incorporating as well this will make you an employee and the business will be a separate entity, this protect your personal assets from law suits, bankruptcy and poor credit ratings If things should go south. You can buy a incorporation kit at any office supply store, or have your accountant do it. Mine charged a $50 fee + state costs for registration (under $100). Cheap insurance. If you do it yourself you have to have it signed by a notary, you can find one at any bank. You will also need to set up a cooperate account there.

I think you go to the county recorder and record you are Doing business as..........This will be a public record that you are using the name.
