I got fobbed off with a fake DVD from an e-bay seller. I'm in the UK and the seller was in the US. I went back to them to complain, but they are not being that helpful, saying I can send it back for a refund for the DVD (by the time I pay postage & pay-pal I'll be lucky to end up with £1 left !!!)

Now they say the DVD was not available in the US, but it is still clearly a fake - Is this legal for them to do this? Other than Pay-pal / e-bay is there anyone else I can take this to?

You can try a refund request to PayPal, but don't hold your breath.

You can also report the sale of a counterfeit DVD to the authorities, (see the link below). In the US Intellectual Property Rights prosecutions are handled by ICE.

File a PayPal claim through their dispute console. You'll be required to send it back with tracking, which as you mentioned will not be worth it. Report it to the police they will advise your were to go next I am sure you have some rights if you do not get a financial result then the police will be on to them.
