we used to.....if you're regarded as "an enemy combatant" (this is decided by one man, king, sorry i mean president bush)... you can be held for a long while (years) without legal council or a hearing as to why you are in custody (Padilla case) during which you will be tortured into saying pretty much anything....that means we're back to the old days when the king locks up anyone who talks back to him....god save this once great nation.....we've become what we've always fought against......there is a quote that fits here:

when they came for the blacks, i said nothing, when they came for the jews, i said nothing, when they came for the catholics, i said nothing, and when they came for me there was nobody to stand beside me.....

Unfortunately, in real life the state may use its power to abuse people.
