Legally, anything not listed in the closing as part of the exchange of properties for money is not part of the sale. One man's garbage is another man's prized possessions.

To be safe, contact the seller and ask what you should do with the items. If they don't respond in a timely fashion (1-3 months), then dispose of them as you see fit.

Send the request by e-mail/certified letter and keep a copy for proof of notification. Otherwise, you could end up in small claims court overa few hundred/thousand dollars with no proof...and have to pay.

I believe that anything left in the house after you took possession become yours to do with whatever you choose. To be on the safe side though I'd send a registered letter with return receipt and let the seller know the tools are there and that he can pick them up. Give a reasonable time frame like two weeks. If they don't pick them up, they are yours. Be sure you safely file the receipt and a copy of the letter you send.

If they were left in the house then I would consider them yours. I think it would be a nice gesture to contact the former owner - maybe through the real estate agent - just to make sure it's not something they didn't mean to leave behind.

The other possibility is the tools were left behind by someone doing work on the house. Again, it's probably fair to claim them a yours unless someone comes looking for them, but you could take the high road and at least do some checking to see if anyone is missing them.

Yes. When I moved I left a few tools, including a ceiling fan, still in the box that I had purchased for the outside patio but never got around to installing. I left them for the new owner.

Honest is the key of succeed in life. Unless those tools are worth million dollars otherwise your reputation is going down the toilet. You will be known as thief for ever.
Don't forget the seller may come back for his tools....

Generally speaking, items left after closing are yours to dispose of or keep, as you choose. However, if the items are of substantial value (more than screwdrivers, hammers, etc.) you would do well to cover your backside by sending a letter to the former owner advising that these items were left behind.

If you hear nothing within a reasonable period of time, you can safely feel that the former owner does not want the items.

Just be cool and call the sellers and ask them if they want them. If not there yours.

They are yours now. If you think that they were left by accident, you may want to call the real estate agent that was involved.
