Okay, a friend of mine is currently in jail because he's getting charges pressed against him for having sex with 3 minors.

One of the girls he had sex with was his g/f when they had the sexual relations and she got pregnant. Well, they broke up shortly after she had the baby and I'm pretty sure they remained friends.

I was just wondering...can that be counted against him since they were in a relationship at the time and she gave him consent (I guess it wouldn't be considered legal consent since she was only 16....) and her parents are not pressing charges?

But, the parents of the girl are not pressing charges...and of course their child is proof.

What I'm asking is...Since the parents of the girl are NOT pressing charges against him, can it still be counted against him in court? I know what statutory rape is and obviously that is what happened in this case...but again...since the parents aren't pressing charges, chan it still be counted against him?

She was 16 at the time and he was 18 and he lives in the state of IL.

Will you please stop making him out to be a bad person? You don't know what happened, nor do I...but I'm hoping for the best. I'm pretty sure he was in a relationship with all three of the girls. But, I'm definetely sure about the one he has a child with.

And, don't drag any of my future children into this, especially since I don't know if my son is going to live or die, being that he's in the NICU.

And, I know it doesn't matter if she was his girlfriend or not. I was just pointing it out that she wasn't some random girl he hooked up with, got pregnant and dumped.

Well, at least someone answered my question.

If my friend had sex with the minor without them wanting it...of course I would think he's "a bad guy". But, if the girls agreed to it...then there's absolutely nothing wrong with it. And, I mean beyond the justice system. Also, the girls he had sex with were all 16...it's not like they are 12 or 13. That would just be sick.

It depends how old he is. In florida, 16 year olds can consent to sex to adults up to the age of 24 years old. After that it would be statitory rape. Everyone over 24 has to make due with 18 year olds.

I think the fact that her parents aren't pressing charges could be used in court. I think parental approval might help his charges. Legally..he's pretty much considered guilty if he's not within a certain age range of 16. Depending on the state.

Because of his age, I believe that her parents consent and a good lawyer could get him out of this jam. If that state is anything like ours. 18 year olds shouldn't get that put on their records for the rest of their lvies, that's ridiculous.

Depends on how old he is and what State they live in! The parents would not have to press charges, the State can! There was a case in Arkansas where the girl got pregnant, that's all it took, the proof was there, the State pressed the charges! The parents had no say!

You don't name your State, and age of consent laws are completely State specific.

Having sex with someone under the age of consent is a crime, and neither the girl herself NOR her parents can give someone else permission to commit a crime.

Criminal charges, in the US, are NOT pressed by the victim or her parents, they are pressed by the State, and the State alone can decide whether to press them or drop them.

Yes, if she was under the age of consent it is considered statutory rape. He can be held accountable for it. The child is actually concrete proof that he did have sexual relationship with a minor!

Edit: It is statutory rape whether the parents agree or not (they do not make the laws). In Illinois the age of consent is 17.

There must be two types of consent. She must be "of age" to consent (usually 16 and up... but 18 in some states) AND she must actually CONSENT (otherwise it is rape).

Her parents don't have to press charges for him to be arrested. Anyone can press charges - social services, etc...

Her being his girlfriend makes no difference.

I would suggest that you drop your "friend" if he is having sex with minors. Eventually, your future little girl might be his next victim.

Well he does sound like a bad person. THREE minors? What's his problem? I would assume that particular case couldn't be held against him if they're not pressing charges, but he's still in trouble. It sounds like jail is where he belongs.

I don't think he can get in trouble, but one never knows. If he were 30 and she were 16 that would be different, but 18 and 16 just don't seem that big a deal. But then what do I know?

Technically,

If your over 18 and have sexual relations with somebody younger than yourself it is considered illegal without a question, even without charges pressed it's still considered rape.

You cant give consent when your 16 years old. So of course it can be held against him. How old is he, and why cant he develop healthy relationships with women over 18? I would say jail is a good place for him.

since she was 16 then you would think but each state is different and the parents would have to say they gave consent for the two of them to see each other. with the parent's admission he should be fine
