Friend who is 17 has recently gotten more sexual with his 16 YO girlfriend. Not actual intercourse but just fingering her. Its in texas and the consenting age is 17 in Texas. But is masterbation of a 16 YO from a 17 YO against the law? Can the parents press charges? Anything else. Just want my bro to be safe with this. Thanks.

Actually, I wouldn't be at all worried if I were your friend. Even if they did have intercourse, it would still be an uphill climb for any prosecutor or solicitor to try him being that there is such a small age difference and the intercourse was consensual. To be honest, it would only be a technicality that it would be considered statutory rape because he is considered an adult and she is not.

The act you are stating though is considered a sexual act and if the solicitor or prosecutor wanted to push the issue, he could be charged with performing a lewd act on a minor and sexual assault of a minor. But again, considering that they are both so close in age and she was obviously a willing participant, I cannot see how a judge or any jury could find him guilty of such unless he did it without her consent.

Most charges relating to sexual conduct between a minor and an adult are for individuals who are much older than their victim and who clearly present a very strong influence on them. For instance, if your friend had been 19 and the girl was 12. Then there may be some kind reason to suspect that your friend coerced her into doing something that she may not have been fully aware of.

It IS against the law in Texas.

Texas doesn't refer to intercourse at all in the law, they refer to "sexual acts", and that would include "fingering". (The actual definition includes ANY act performed for the "sexual gratification" of either party.)

The real question is whether her parents would want to press charges, or if your brother can convince them that he is a stand-up guy who cares about her and will keep her from harm.

If the parents wanted to press charges, they could, but I believe they would be charged as juveniles.

no unless it was forced then it would be rape. it would only be against the law if it was actuall intercorse.
